We are hereby documenting the Joint Statement for the Immediate Treatment and Release of the Trade Union Leader Shady Mohamed

We, the undersigned political and human rights groups, labor and public figures, are following with great concern the continued pretrial detention of trade union leader Shady Mohamed pending Case No. 1644 of 2024, known as «the Palestine Banner Case», exceeding the legal maximum limit for pretrial detention, amid a serious deterioration in his health condition.

Shady has been suffering for months from an injury to his left shoulder that prevents him from moving his arm, with suspected tendon rupture that requires an MRI and urgent treatment. Despite medical recommendations and official requests before the prosecution and the court, no date has yet been set for conducting the MRI or providing the necessary treatment, in clear violation of his right to health care and physical well-being.

His continued detention without trial, while being denied treatment, turns pretrial detention into an actual punishment and a danger to his life. Article 18 of the Egyptian Constitution obliges the state to provide healthcare to every citizen, considering it a guaranteed right, not a favor, also article 55 explicitly states that anyone arrested or detained in pretrial detention must be treated in a manner that preserves their dignity and may not be harmed physically or morally, violating this is a crime punishable by law. At the international level, Article 10 of the International Covenant on Civil and Political Rights obliges the State to treat all those deprived of their liberty in a humane manner that preserves the inherent dignity of the person. Deliberate delay in providing treatment to a detainee suffering from a medically documented injury does not fall under administrative negligence, but rather constitutes a form of cruel and inhuman treatment in the sense prohibited by these Articles. If this negligence leads to the death of the detainee, it amounts to a crime of premeditated murder by abstention, for which the authorities concerned with his detention and health care bear responsibility.

Therefore we demand:
● Releasing Shadi Muhammad immediately and to stop exceeding the period of pretrial detention.
● Enabling him to immediately conduct MRI scans and receive treatment and surgery if necessary, within an appropriate medical facility, without delay or security requirements that disrupt care.
● Holding the authorities responsible for the delay in providing treatment accountable, and ensuring that this does not happen again to any detainee.
● Ending the use of pretrial detention and medical negligence as a tool of punishment for legitimate solidarity with Palestine.

Solidarity with Palestine is not a crime. Shady’s life and health are not for bargaining.
